  1. c) The domain name legalup.in (“Website”) is owned and operated by LegalUp, a startup providing comprehensive legal assistance services.

 

  1. d) In this Privacy Policy (“Policy”), the terms ‘You’ and ‘User’ refer to any legal person or entity accessing or using the services provided on this Website, who is competent to enter into binding contracts as per the provisions of the Indian Contract Act, 1872. The terms ‘We,’ ‘Us,’ and ‘Our’ refer to the Website and/or LegalUp, as the context requires. The terms ‘Party’ and ‘Parties’ refer to the User and LegalUp individually and collectively, as the context requires.

  1. c) In the event of mergers, acquisitions, or reorganization of LegalUp’s business, personal information may be shared or sold with other business entities, which will continue to adhere to the terms and policies outlined herein.

 

  1. SECURITY

 

LegalUp ensures secure and protected transactions on the website. User information entered during transactions is encrypted to prevent unintended disclosure to third parties. Credit and debit card information is not received, stored, or retained by LegalUp, as it is directly supplied to authorized payment gateways compliant with relevant regulations and requirements.

 

  1. THIRD-PARTY ADVERTISEMENTS / PROMOTIONS

 

LegalUp may use third-party advertising companies to deliver customized advertisements based on users’ visits to the website and other sites. The website may contain links to other websites collecting personally identifiable information, for which LegalUp holds no responsibility and users assume associated risks.

 

  1. USER’S CONSENT

 

By using the LegalUp website and providing information through it, users consent to the collection and use of disclosed information in accordance with this Privacy Policy, including the sharing/divulging of information as outlined in Section 4.

  1. DISPUTE RESOLUTION AND JURISDICTION

 

The Parties acknowledge and agree that any disputes arising from or related to this Policy shall be resolved through a two-step Alternate Dispute Resolution (“ADR”) mechanism, with the understanding that this provision remains valid even after the termination or expiry of the Policy and/or Terms.

 

  1. a) Mediation: If a dispute arises between the Parties, they will make reasonable efforts to resolve it amicably through mutual discussions. Should the Parties fail to reach a satisfactory resolution within thirty (30) days from the date of either Party notifying the other Party of the dispute, the matter will be referred to arbitration, as outlined below.

 

  1. b) Arbitration: If mediation does not result in a resolution, the dispute will be referred to arbitration. The arbitration proceedings will be conducted by a sole arbitrator appointed by LegalUp, and the arbitrator’s decision will be final and binding on both Parties. Each Party shall bear its own costs unless the arbitrator directs otherwise. The arbitration shall be conducted in English, and the seat of arbitration shall be in New Delhi, India.

 

The Parties explicitly agree that the Terms, Policy, and any other agreements between the Parties are governed by the laws, rules, and regulations of India. They further agree that any disputes arising between the Parties shall be subject to the exclusive jurisdiction of the courts in Delhi, India.
