Accountability Policy

LegalUp promises Accountability to its clients in lieu of its ‘3A’ Mantra. This promise is fulfilled by our ‘Accountability Policy’. The Accountability Policy is subject to, and must be read along with the Disclaimer, Terms & Conditions, and Privacy Policy listed separately on our website.

Every Client has the right to raise an ‘Accountability Claim’ with LegalUp by sending an email to [email protected] specifying their grievances along with details of the service(s) purchased and order/transaction details. On assessment of the claim, if it is found that there is a genuine grievance or an unjustified delay is caused to the client, then in such an event LegalUp shall immediately take appropriate action to remedy the situation. In addition, such grievance or delay should be attributable to the operations of LegalUp and should be one that is within the scope of the operations of LegalUp.

Beyond the control

Any delay on behalf of any governmental authority or department, etc. including, but not limited to, the Ministry of Corporate Affairs (“MCA”), and the Controller of Certifying Authorities (“CCA”), any change in Law or Statute, or change in Procedures prescribed by the relevant authorities or agencies of such relevant authorities, Natural Disasters, Acts of Nature, or acts of Affiliates or Third-Party Professionals or Vendors, shall not be considered  as an appropriate cause of action to initiate an Accountability Claim since the aforementioned are beyond the control of LegalUp.

Further, LegalUp shall not be responsible for any delays attributable to the client in utilisation of any service listed on the website, or otherwise, and shall include acts like submission of the required documents or information. Such a claim shall not be covered under the Accountability Policy.

Furthermore, LegalUp does not guarantee any results or outcome of a process where governmental or quasi-judicial or any regulatory authority is involved. For instance, the concerned authority might object to, or reject, the client’s proposed company name due to reasons beyond the control of LegalUp, or change in a government SOP due to amendments or updates in rules. There are also instances where a government website is down or slow due to which LegalUp is not able to complete an order in the prescribed time. Such situations are beyond the control of LegalUp and LegalUp shall not be liable for the same.

 

 

POLICY FOR CHANGE OF SERVICE

In case you change your services from the original one with another service offered by LegalUp then you may make a written request to LegalUp within 07 days of the receipt of payment by LegalUp. LegalUp shall accept the request for change in service provided the original service is not completed/fulfilled by LegalUp at the time of receipt of such request.

The fees paid for the original service after deducting the government fees, affiliate fees, or any fees charged by any third-party professional/vendor, if any, shall be duly adjusted against the new service order. Any additional fees for the new service shall be payable by the client after such request for change in service has been accepted by LegalUp.

 

REFUND POLICY

We put our sincere efforts to satisfy our clients but if despite our hardest efforts you are not satisfied then you may initiate a claim for refund as per the following terms – 

  • The refund can only be claimed in case of conspicuous and clear deficiency/error in the service(s) provided by LegalUp.
  • No refund shall be paid for change of mind or mood or situation of the client and LegalUp shall not be liable for the same.
  • If the request for refund has been raised after the completion of the service(s), or after the fulfilment of the new service in case of a change in service, then the client shall not be eligible for refund and such refund request shall be considered invalid.
  • The client shall not be eligible for refund in cases of delay found on the behalf of the client in submission of the required documents or information pertaining to any service.
  • The client will not be eligible for refund, if after 60 days of making payment to LegalUp for any service(s), such service(s) is not fulfilled due to delay on the behalf of the client in submitting the required documents or information pertaining to such service(s). LegalUp shall not hold any liability for such abandoned orders. The amount against such orders shall be utilised and considered as the cost incurred by LegalUp for providing information to the client, or following up, or providing consultancy during the said period.
  • Delay on behalf of govt.
  • Any delay beyond the control of LegalUp
  • If the client requests for a change of service with which is of less value, then the differential amount shall be refunded. 
  • After approval of the refund from LegalUp, such refund shall be processed within 30 days from the date of acceptance of the claim. Further, the refund amount shall be restricted to the professional fees payable to LegalUp, and shall exclude all government fees, taxes, charges, challan payments, third-party payments, payment gateway charges, etc.
